छठे नंबर की इकोनोमी

नकारात्मक खबरों से जूझती भारतीय अर्थव्यवस्था के लिए एक अच्छी खबर आई है। आईएमएफ के वर्ल्ड इकनॉमिक आउटलुक (डब्ल्यूईओ) के मुताबिक फ्रांस को पीछे धकेल कर भारत विश्व की छठी सबसे बड़ी अर्थव्यवस्था बन गया है। इंडियन इकॉनमी का आकार अब 2.6 लाख करोड़ डॉलर हो गया है, जो 2.5 लाख करोड़ डॉलर के मानक के मुकाबले ठीकठाक ऊपर है। माना जाता रहा है कि 2.5 लाख करोड़ डॉलर वाला बिंदु विश्व की बड़ी अर्थव्यवस्थाओं को बड़ा बनने की कोशिश में लगी अर्थव्यवस्थाओं से अलग करता है। हालांकि फ्रांस भी भारत से ज्यादा पीछे नहीं है और कुछ अनुमान बता रहे हैं कि शायद इसी साल वह भारत को पछाड़ कर फिर से छठा स्थान हासिल कर ले। मगर भारतीय नीति निर्माता इस उपलब्धि को यूं ही हाथ से नहीं निकलने देना चाहेंगे। एक लिहाज से यह है भी नंबर गेम ही। देश एक स्थान ऊपर माना जाए या नीचे, इससे न तो देश में रोजगार की स्थिति बेहतर होने वाली है, न ही कंपनियों के मुनाफे में कोई फर्क दिखने वाला है। लेकिन अच्छी रैंकिंग न केवल उम्मीद का माहौल बनाती है बल्कि दुनिया को धारणा बनाने में मदद भी करती है। इसका सीधा असर निवेश संबंधी फैसलों पर पड़ता है। विश्व बैंक और मुद्रा कोष ने माना है कि नोटबंदी और जीएसटी जैसे आवश्यक सुधारों से पैदा हुई कठिनाइयों से भारत काफी हद तक उबर चुका है और अब इसके अच्छे नतीजे दिखने शुरू हो सकते हैं। लेकिन दोनों ने यह नसीहत देने से परहेज नहीं किया कि इन संभावनाओं का पूरा फायदा उठाने के लिए सुधार के लंबित पड़े अजेंडे पर तेजी से अमल शुरू करना जरूरी है। वैसे, अर्थव्यवस्था की इस रैंकिंग से उपजे उत्साह का पूरा सम्मान करते हुए भी हमें इसकी सीमाएं याद रखनी चाहिए। आज छठा स्थान हमें रोमांचित कर रहा है, पर गणना की दूसरी पद्धति पीपीपी यानी परचेजिंग पावर पैरिटी के हिसाब से तो हम तीसरे स्थान पर खड़े हैं। यानी हमारा मार्केट हमसे कहीं ज्यादा बड़ी अर्थव्यवस्था वाले देशों से भी ज्यादा बड़ा है। इसके बावजूद हम बाल कुपोषण, महिला अशिक्षा और स्वास्थ्य सेवाओं तक लोगों की पहुंच जैसे मामलों में अपने से बहुत छोटी और पिछड़ी अर्थव्यवस्थाओं से भी पीछे हैं। यानी अपने देश में आम नागरिकों को जैसा जीवन हम उपलब्ध करवा पाए हैं उसकी क्वॉलिटी की उन देशों से कोई तुलना नहीं हो सकती, जिनसे आर्थिक विकास के आंकड़ों की लड़ाई हम लड़ रहे हैं। साफ है कि किसी भी सरकार के लिए इन आंकड़ों से ज्यादा महत्वपूर्ण सवाल यह बनना चाहिए कि आर्थिक विकास से पैदा होने वाले संसाधनों का देशवासियों के बीच बंटवारा कितना न्यायपूर्ण है। जिस विकास की बात अभी की जा रही है, वह भी टिकाऊ तभी बनेगा जब इस सवाल को भरपूर अहमियत मिलेगी।

भारत ने सीरिया में रासायनिक हथियारों के इस्तेमाल की आशंका के मद्देनजर दुनिया भर में उठ रहे सवालों के बीच जो रुख अपनाया है वह पूरी तरह वाजिब और विश्व शांति के तकाजों के अनुरूप है। नीदरलैंड में भारतीय राजदूत वेणु राजमणि ने रासायनिक हथियार निषेध संगठन (ओपीसीडब्ल्यू) की कार्यकारी परिषद की बैठक में कहा कि भारत रासायनिक हथियारों के एकदम खिलाफ है, पर इसके कथित इस्तेमाल से जुड़े विषयों की जांच पूरी तरह से रासायनिक हथियार संधि के अनुरूप ही होनी चाहिए। सीरिया की बशर अल-असद सरकार पर यह आरोप है कि उसने अपने घरेलू विद्रोहियों के खिलाफ रासायनिक हथियार इस्तेमाल किए। इसी बिना पर पिछले दिनों अमेरिका और ब्रिटेन तथा फ्रांस ने सीरिया पर मिसाइलों से हमला किया, और यह दावा किया कि केवल उन जगहों को निशाना बनाया गया जहां रासायनिक हथियार छिपा कर रखे गए थे।

इस सैन्य कार्रवाई ने दुनिया में बड़े पैमाने पर सामरिक टकराव का अंदेशा पैदा कर दिया, क्योंकि सीरिया अकेला नहीं है, रूस भी उसके साथ खड़ा है और 2015 से वहां रूस की फौजी मौजूदगी भी है। लेकिन सवाल यह है कि क्या सचमुच सीरिया ने अपने विद्रोहियों के खिलाफ रासायनिक हथियार इस्तेमाल किए थे? इसकी मुकम्मल जांच होनी चाहिए। लेकिन अंतरराष्ट्रीय पर्यवेक्षकों के अपनी रिपोर्ट देने से पहले ही अमेरिका ने हमला बोल दिया। जबकि रासायनिक हथियारों का भंडारण और इस्तेमाल रोकने के लिए बाकायदा एक वैश्विक संस्था ओपीसीडब्ल्यू यानी ‘आर्गनाइजेशन फॉर द प्रोहिबिशन ऑफ केमिकल वीपन्स’ है, जो कि सीडब्ल्यूसी यानी ‘केमिकल वीपन्स कनवेन्शन’ नामक संधि की देन है।

यह संधि एक तरह से 1925 में रासायनिक हथियारों के खिलाफ बने जेनेवा प्रोटोकॉल का विस्तार है। रासायनिक और जैविक हथियारों को प्रतिबंधित करने की बाबत वैश्विक करार की पहल 1968 में हुई, अठारह देशों की सदस्यता वाली निरस्त्रीकरण समिति के भीतर। सितंबर 1992 में इस समिति ने संयुक्त राष्ट्र महासभा को एक रिपोर्ट सौंपी, जिसमें रासायनिक हथियारों पर रोक लगाने की वैश्विक संधि का प्रस्तावित मसविदा भी था। फिर, महासभा ने उसी साल नवंबर में संधि को मंजूरी दे दी, और इसे तमाम देशों के हस्ताक्षर के लिए जारी कर दिया गया। दुनिया के 192 देश इस संधि को स्वीकार कर चुके हैं। जाहिर है, लगभग सारी दुनिया इस संधि को मानती है। न मानने वाले अपवाद हैं। मसलन, इजराइल ने इस संधि पर हस्ताक्षर तो किए हैं, पुष्टि नहीं की है। उत्तर कोरिया, मिस्र और दक्षिण सूडान ने तो हस्ताक्षर भी नहीं किए हैं। विडंबना यह है कि जिस सीरिया पर रासायनिक हथियार रखने और उसका इस्तेमाल करने का आरोप लगा है वह भी संधि पर हस्ताक्षर कर चुका है। संधि के तहत रासायनिक हथियारों का बड़े पैमाने पर उत्पादन, भंडारण और इस्तेमाल प्रतिबंधित है।

एक बहुत सीमित मात्रा में छूट दी गई है, चिकित्सा और वैज्ञानिक अनुसंधान के मकसद से। समस्या यह है कि कई जहरीले रसायनों का दुनिया भर में बड़े पैमाने पर उत्पादन और स्थानांतरण होता है, जो प्रतिबंधित नहीं है, क्योंकि वे औद्योगिक उत्पाद बनाने या औद्योगिक प्रक्रियाओं में काम आते हैं। लिहाजा, रासायनिक हथियारों पर रोक लगाने की कठिनाई वैसी ही है जैसी परमाणु हथियारों का प्रसार रोकने की। जिस तरह परमाणु ऊर्जा का शांतिपूर्ण उपयोग भी है उसी तरह अनेक विषैले रसायनों का भी औद्योगिक उपयोग होता है। लेकिन दुनिया में अगर कहीं रासायनिक हथियार रखने या उसका इस्तेमाल किए जाने की सूचना मिलती है या वैसा आरोप सामने आता है, तो संधि को क्रियान्वित करने वाली संस्था यानी ओपीसीडब्ल्यू को मौके पर जाकर जांच करने का अधिकार है। कार्रवाई की बात उसके बाद आती है। भारत ने जहां रासायनिक हथियारों के खिलाफ होने की बात कह कर सीरिया को सख्त संदेश दिया है, वहीं संधि के प्रावधानों के अनुपालन का प्रश्न उठा कर अमेरिका व उसके मित्र देशों को भी यह जताया है कि उन्हें मनमर्जी करने से बाज आना चाहिए।

महंगा होता तेल

वैसे मुहावरा तो तेल की धार देखने का है, लेकिन हमारे यहां अक्सर तेल की मार ही देखी जाती है। शुक्रवार को भारतीय बाजारों में पेट्रोल की कीमत पिछले 55 महीने के सबसे ऊंचे स्तर पर पहुंच गई। इस समय देश भर के पेट्रोल पंप पर आपको जिस कीमत पर पेट्रोल मिल रहा है, वह इसकी ऐतिहासिक बुलंदी से थोड़ा सा ही नीचे है। या यूं कहें कि यह इतिहास की दूसरी सबसे ऊंची बुलंदी है। लेकिन डीजल की कीमतों ने तो शुक्रवार को इतिहास ही बना दिया। इस समय जिस कीमत पर बाजार में डीजल मिल रहा है, उस कीमत पर वह इससे पहले कभी नहीं मिला। कीमत बढ़ने का सीधा दोष हम सरकार को नहीं दे सकते हैं। बहुत साल पहले जब केंद्र में यूपीए की सरकार थी, यह तभी तय हो गया था कि पेट्रोल की कीमतें अब अंतरराष्ट्रीय बाजार से जुड़ जाएंगी। जब वहां कच्चा तेल महंगा होगा, तो हमारे बाजार में पेट्रोल महंगा हो जाएगा और जब वहां यह सस्ता होगा, तो हमारे यहां सस्ता मिलने लगेगा। मौजूदा एनडीए सरकार भी उसी नीति को आगे बढ़ा रही है। इस सरकार ने बस इतना ही किया है कि उसने साप्ताहिक या मासिक निर्धारण की बजाय पेट्रोल की कीमत का अंतरराष्ट्रीय बाजार के हिसाब से दैनिक निर्धारण शुरू कर दिया है। इसलिए अब हर रोज हमें पेट्रोल अलग दाम पर मिलता है। जहां तक अंतरराष्ट्रीय बाजार की बात है, तो शुक्रवार को कच्चे तेल की कीमत 75 डॉलर प्रति बैरल पहुंच गई है। यह पिछले चार साल का सबसे ऊंचा स्तर है। इस समय ओपेक देशों ने जिस तरह कच्चे तेल की आपूर्ति घटा दी है, उससे आने वाले दिनों में यह कीमत और ऊंची जाने की आशंका है। यानी हमारे बाजार में भी कीमतें बढ़ना लगभग तय है।
आम जनता की नजर से देखें, तो आपत्ति यही है कि जब दुनिया के बाजारों में कच्चे तेलों की कीमत बहुत कम थी, तो इसका लाभ भारतीय उपभोक्ताओं को बहुत ज्यादा नहीं मिला। शुरू में कुछ दाम भले ही घटे हों, लेकिन बाद में दुनिया के बाजार में इसकी कीमत भले ही जितनी भी नीचे आई हो, हमारे यहां इस पर कर भार बढ़ाकर पेट्रोल और डीजल के दाम को जस का तस रहने दिया। यानी फायदा तो नहीं मिला, लेकिन अब जब दाम बढ़ रहे हैं, तो इसका घाटा जरूर भारतीय उपभोक्ताओं को झेलना पड़ रहा है। एक उम्मीद यह बनी थी कि अगर पेट्रोल जीएसटी के दायरे में आ जाता, तो इस लगने वाले तरह-तरह के टैक्स खत्म हो जाएंगे और फायदा उपभोक्ताओं को मिलेगा। लेकिन केंद्र और राज्यों की सरकारें अभी इसके लिए तैयार नहीं दिख रहीं। दुनिया के बाजार में कीमतें अगर इसी तरह बढ़ती रहीं, तो हमारी परेशानियों का बढ़ना लगभग तय है। पेट्रोल और डीजल के दाम जब बढ़ते हैं, तो सिर्फ आवागमन महंगा नहीं होता, इससे किराया भाड़ा भी बढ़ता है और तकरीबन हर चीज के दाम ऊपर की ओर जाने लगते हैं। किसानों के लिए सिंचाई भी महंगी हो जाती है और बहुत सी चीजों की लागत भी बढ़ जाती है। उर्वरक समेत वे सारी चीजें महंगी होने लगती हैं, जिनके उत्पादन में पेट्रोलियम पदार्थों का इस्तेमाल कच्चे माल के तौर पर होता है। पेट्रोलियम पदार्थों की वजह से बढ़ने वाली मुद्रास्फीति ने देश को कई बार परेशान किया है। यह फिर न हो इसके लिए केंद्र और सरकारों को पेट्रोलियम पदार्थों पर लागू कर संरचना को बदलना होगा। जीएसटी के जमाने में पेट्रोल पुराने तरीके से नहीं चलना चाहिए।

महाभियोग की नौबत नहीं आती तो बेहतर होता

देश के सात विपक्षी दलों ने भारत के मुख्य न्यायाधीश दीपक मिश्र के विरुद्ध उपराष्ट्रपति वेंकैया नायडू को महाभियोग का नोटिस देकर दुर्भाग्यपूर्ण स्थिति पैदा कर दी है। विपक्ष ने उनके विरुद्ध पांच आरोप लगाए हैं। यह स्थिति संविधान और उसकी संस्थाओं के प्रति गहराते अविश्वास को और बढ़ाएगी, क्योंकि राजनीतिक नेतृत्व के विचाधारात्मक पक्षपात से दुखी लोग न्यायपालिका को ही अंतिम विकल्प मानकर चलते हैं। अब अगर उसकी छवि पर खुले आम राजनीतिक बहसों और आरोपों-प्रत्यारोपों का दौर चलेगा तो इससे भारतीय लोकतंत्र की घरेलू और विदेशी छवि की और छीछालेदर होगी। इसीलिए सुप्रीम कोर्ट ने एडवोकेट जनरल से यह इच्छा भी व्यक्त की है कि इस मामले को मीडिया रिपोर्ट न करे। विपक्षी दलों ने कहा भी है कि उनके पास इसके अलावा कोई चारा भी नहीं था। महाभियोग के पीछे तात्कालिक वजह तो सीबीआई के विशेष जज बृजगोपाल हरिकिशन लोया की मौत की जांच की याचिका का खारिज किया जाना है। मुख्य न्यायाधीश दीपक मिश्र, न्यायमूर्ति एएम खानविलकर और न्यायमूर्ति डीवाई चंद्रचूड़ की पीठ ने न सिर्फ उस याचिका को खारिज किया है बल्कि जनहित याचिका करने वालों को फटकारते हुए कठोर टिप्पणियां भी की हैं। अदालत चाहती है कि राजनीतिक विवाद को निपटाने के लिए सुप्रीम कोर्ट के मंच का इस्तेमाल न किया जाए, क्योंकि उसके लिए संसद जैसी संस्था है। ऐसा कहते हुए न्यायपालिका यह भूल गई कि सोहराबुद्‌दीन की मुठभेड़ में मौत का मामला भारतीय विधिशास्त्र को चुनौती दे रहा है। ताकतवर लोगों के दबावों के चलते इस मामले में इंसाफ नहीं मिल पा रहा है। इसलिए अगर सुप्रीम कोर्ट जज लोया की मृत्यु को संदेहास्पद मानता तो गंभीर किस्म का टकराव पैदा होता लेकिन, अदालत ने याचिका को खारिज करके अपने को संदेह के दायरे में ला दिया है। मक्का मस्जिद मामले के आरोपी असीमानंद से लेकर नरोदा पाटिया मामले में सजा पा चुकी माया कोडनानी का छूटना देश के मानस में कई सवाल खड़े करता है। न्यायमूर्ति चेलमेश्वर और पूर्व न्यायमूर्ति अभय एम थिम्से अपने बयानों से उन सवालों को गंभीर रूप दे चुके हैं। महाभियोग स्वीकार हो या पराजित हो यह बाद की बात है लेकिन, यह नौबत ही लोकतंत्र के लिए चिंताजनक है।

महाभियोग का मकसद

जज बीएच लोया की मौत के मामले में मनमाफिक फैसला न आने के तत्काल बाद कांग्रेस और कुछ अन्य दलों ने सुप्रीम कोर्ट के मुख्य न्यायाधीश दीपक मिश्र के खिलाफ महाभियोग लाने की जैसी हड़बड़ी दिखाई और राज्यसभा के सभापति को इस आशय का प्रस्ताव भी सौंप दिया उससे उसकी खिसियाहट ही प्रकट हो रही है। देश के राजनीतिक इतिहास में यह पहली बार है जब संकीर्ण राजनीतिक कारणों से सुप्रीम कोर्ट के मुख्य न्यायाधीश के खिलाफ महाभियोग लाने की पहल की गई है। यह राजनीति के गिरते स्तर का नया प्रमाण है। कांग्रेस एक बेहद खराब परंपरा की शुरुआत कर रही है। इससे उसे अपयश के सिवाय और कुछ हासिल होने वाला नहीं है, यह महाभियोग प्रस्ताव पर पूर्व प्रधानमंत्री मनमोहन सिंह के हस्ताक्षर न करने से भी स्पष्ट है। सलमान खुर्शीद एवं कुछ अन्य कांग्रेसी नेता भी इस प्रस्ताव से असहमत हैं। सलमान खुर्शीद ने यह कहकर एक तरह से कांग्रेस की पोल ही खोली है कि सुप्रीम कोर्ट के निर्णय या नजरिये से असहमति के आधार पर महाभियोग नहीं लाया जा सकता। इसके बाद भी नेता एवं वकील की दोहरी भूमिका में सक्रिय रहने वाले राज्यसभा सदस्य कपिल सिब्बल महाभियोग प्रस्ताव को सही ठहराने में लगे हुए हैं। उनका साथ अन्य अनेक कांग्रेसी नेता भी दे रहे हैं। कहना कठिन है कि महाभियोग की पैरवी कर रहे ये कांग्रेसी नेता सचमुच राहुल गांधी के शुभचिंतक हैं, क्योंकि महाभियोग संबंधी प्रस्ताव की भाषा भले ही कुछ और हो वह यही बता रही है कि वांछित निर्णय न आने पर ही मुख्य न्यायाधीश को निशाने पर लिया जा रहा है। यह कीचड़ फेंक कर भाग निकलने वाला रवैया है। कांग्रेस को यह रवैया बहुत महंगा पड़ेगा, क्योंकि वह राजनीतिक लड़ाई को एक नए, किंतु निम्न स्तर पर ले जा रही है। 1महाभियोग एक लंबी एवं जटिल प्रक्रिया है और अभी तक का अनुभव यही बताता है कि इस प्रक्रिया को अंजाम तक पहुंचाना खासा मुश्किल होता है। अगर मुख्य न्यायाधीश के खिलाफ महाभियोग प्रस्ताव लाने की नोटिस स्वीकार भी हो जाती है तो भी उसके पारित होने के आसार नहीं, क्योंकि एक तो कांग्रेस महज छह-सात दल ही अपने साथ खड़ी कर सकी है और दूसरे, केवल राज्यसभा में ही प्रस्ताव पारित होना पर्याप्त नहीं। यह प्रस्ताव दोनों सदनों से पारित होना चाहिए और इसके आसार दूर-दूर तक नहीं। कांग्रेस इस प्रस्ताव के हश्र से अनभिज्ञ नहीं हो सकती, लेकिन यदि वह सब कुछ जानते हुए भी आगे बढ़ रही है तो इसका मतलब यही है कि उसका एक मात्र मकसद यह माहौल बनाना है कि सुप्रीम कोर्ट सरकार के इशारे पर चल रहा है। यह एक संवैधानिक संस्था की छवि को जानबूझकर मलिन करने की शरारत भरी कोशिश के अलावा और कुछ नहीं। ऐसा लगता है कि कांग्रेस संस्थाओं को नष्ट करने और उनकी छवि खराब करने की अपनी पुरानी प्रवृत्ति का परित्याग नहीं कर पा रही है। वह महाभियोग प्रस्ताव के जरिये एक तरह से न्यायपालिका को यही संदेश देने की कोशिश कर रही है कि अगर फैसले उसके हिसाब से नहीं आए तो वह उसकी पगड़ी उछालने का काम कर सकती है।

There are many explanations for Indian banks’ bad loan crisis, best captured by the increase in stressed assets from 5.9% of loans in March 2011 to 11.9% in December 2017. But if there is a common thread running through myriad explanations, it is that a permissive regulatory culture allowed banks to understate the extent of the problem. Consequently, a predictable increase in bad loans when economic growth slowed down turned into a serious problem which required a massive bout of recapitalisation of public sector banks. It is this permissiveness which RBI is belatedly eliminating – with pushback from industry and others.

For example under the tightened norms for classifying a loan as an NPA, borrowers are expected to meet their payment obligations on the due date. But finance ministry reportedly wants RBI to relax this one-day default norm to 30 days for a period of one year. Attempts to tighten the system in the past have also been countered by arguments that both banks and floundering firms need handholding during a difficult phase. Indeed, even the current resolution framework does that. The primary objective is not to liquidate a company unable to repay a loan, but to resolve the problem. In the process, oftentimes the promoter of a firm and a bank may have to bear a cost. This is far better than delayed recognition of problems that allows many to game the system, leaving the hapless taxpayer to pick up the tab. Government, therefore, should firmly back RBI’s attempt to change this system.
What is being worked out is a framework for timely recognition of problems and a gradual escalation of the resolution process for troubled loans. If this system works well India can significantly improve its 26% recovery rate for bad loans – as compared to over 90% in Japan.

Not this Way
A group of seven Opposition parties has submitted a notice for an impeachment motion against Chief Justice of India Dipak Misra citing five reasons. This is the first such move against the top judge of the apex court in the country. It is a moment for a nation to pause, take a deep breath, ask some questions. First and fundamentally: Is impeachment, which is the extreme step to punish an errant judge, merited in this case? India’s Constitution prescribes a layered and cumbersome process involving several stages. The bar is set deliberately high on the admissibility of such a move because the consequences for the system can be destabilising and debilitating. The judiciary is the guardian of the Constitution and its guarantee of individual liberties. Its independence is indispensable for other institutions and for the framework of checks and balances to remain in good health. So, do the five grounds on which CJI Dipak Misra is sought to be indicted meet the standard, pass the test? They don’t.

There is an unmistakable air of tentativeness about the chargesheet drawn up against CJI Misra — his alleged involvement in a case relating to an educational trust that allegedly involved the payment of illegal gratification, his acquisition of land 39 years ago and surrendered later, his allocation of cases as master of roster. An impeachment motion must involve clear incapacity or proven misconduct. It cannot be the instrument by which mere suspicions about a judge’s conduct are sought to be expressed or confirmed. It cannot be propelled by a difference of views in court. An impeachment motion must not be — it must not be seen to be — mired in the politics of the day. The move of the Opposition parties against the CJI comes a day after a CJI-led bench spoke on a case that has drawn extraordinary political attention — it dismissed petitions that sought an independent probe into the 2014 death of Judge BH Loya, who at that time was hearing the Sohrabuddin fake encounter case in which BJP president Amit Shah was an accused. Its timing does little to insulate the impeachment notice from Union Finance Minister Arun Jaitley’s accusation that it is a “revenge petition”.

To be sure, there is an unseemly stand-off, an unprecedented breakdown of trust within the Supreme Court today. Sharp anxieties have also been stoked about the court’s ability and willingness to stand up to an executive armed with a decisive mandate, in the matter of the stalled Memorandum of Procedure or government delay in clearing appointments recommended by the Collegium. It is also true that for both these crisis, the CJI must take prime responsibility. Yet, an impeachment move by a divided Opposition is neither the answer nor the way out. It will only lead to a bruising politicisation of a court already divided, and to its embitterment, at a time when it needs to stand firm against external challenge. Perhaps the Opposition leaders helming the impeachment move should have listened to Justice J Chelameswar, one of the four SC judges who held a press conference against the CJI in January, but who insists that the solution must be found through an institutional “audit” and by putting in place a “proper alternative” — through correcting the system, that is, not by unsettling it.

Don’t Destroy the Dignity of Higher Judiciary
The Supreme Court has imparted legal quietus to the controversial case of Justice B H Loya’s death. A curative petition is still a theoretical possibility, although nothing substantial is likely to issue from the exercise of that option. Not even an FIR on the disputed circumstances of his death can now be filed. The SC was scathing in its indictment of the PIL and even went so far as to doubt the motives of the petitioners. Business and political rivalries ought to be settled in their respective domains and the judiciary must not be brought in to effectuate desirable outcomes, the court said, waxing trenchant. Holding the written statements of the four brother judges on Loya’s death to be indisputable—as also the medical and other documents—the court refused to entertain any scepticism on the conclusion that it was a natural death.

But however upset the Lordships say they are for the court being “used” for what they deemed was a politically motivated PIL, the legal closure they have sought to impart is unlikely to bring the curtains down on the whole Loya affair. The political slugfest will continue, perhaps even intensify. The BJP has been on a campaign to portray this as a Congress conspiracy to malign its party chief.

The Grand Old Party, its friends and allies are equally unlikely to stop raising the questions they feel have not been adequately answered and are still hanging in the air. Nor is the lack of consensus restricted to the political field. Remember, it was this issue that was singled out and named as one of the triggers for the unprecedented press conference held by the puisne judges of the Supreme Court, targeting Chief Justice Dipak Misra’s handling of the roster.

Also, a day after the judgment, the Opposition has initiated impeachment proceedings against the CJI, also an event without precedent. It is incumbent on all sides, however, even as they follow their tactics and conscience, that they retain a sense of dignity and gravitas around the higher judiciary. India needs all the institutional stability it can get.

Blood on their hands
It is believed that the success of a democracy depends on the maturity of its politicians. Indian democracy’s record in this respect is debatable. This is because Indian politicians have, over the years, shown a marked preference for politicizing events. Even tragedies – such as deaths of humans or critically endangered animals – do not remain untouched by the pettiness of politics. The war of words between a Union minister and the chief minister of West Bengal over the killing of a tiger that had strayed into a not-so-dense forested patch in West Midnapore district exposes, once again, the multiple challenges that confront India’s conservation discourse. Maneka Gandhi – her concern for the welfare of animals has not been dimmed by the pressure of leading the women and child development ministry – has blamed the tiger’s killing on adivasis who, in the minister’s opinion, kill thousands of animals during their hunting festivals. She has alleged that Mamata Banerjee has not put a stop on the practice because of political compulsions. Ms Banerjee responded to the allegation by saying that the minister had disrespected the adivasicommunity.

The exact identity of the slayers of the tiger is yet to be established, even though it is known that adivasis had been entering the forest to observe a traditional hunt. But the matter is not only about identifying the killers. The trading of barbs between the two leaders is unfortunate because the exchange threatens to deflect attention from some fundamental assumptions. Ms Gandhi seems to have ignored established scholarly evidence of the role of forest communities in the conservation enterprise. The Bishnois of Rajasthan may be a celebrated lot but they are not the only saviours of the environment. In the Biligiri Rangaswamy Temple tiger reserve in Karnataka, the population of the big cat actually doubled after adivasis were allowed to co-exist with the animal. Yet, there is discernible pressure on the part of the government to retain the forests that remain as exclusive preserves of the forest department whose writ runs larger than that of the original inhabitants. Worryingly, the new draft national forest policy is allegedly inclined to reverse the modest gains made by an earlier law that seeks to restore to indigenous people their right over forests. Ms Gandhi’s knowledge of tribal traditions appears to be rudimentary. Perhaps she could deign to read the numerous anthropological accounts of traditional knowledge systems that clearly advocate a syncretic relationship between communities and forests. Modern conservation can, in fact, learn a lot from these illuminating treatises.

Ms Banerjee is also complicit, but in a different way. Her alacrity to defend the adivasicommunity should have been matched by a briskness that would have forced the state forest department to get its act together. Several questions have been raised about the skills and the training of the team that was dispatched to protect a solitary, vulnerable animal. Little wonder then that Ms Banerjee has chosen to answer other, less troublesome, queries.
